Pushworth Artist Code
Effective Date: 1 July 2025

Preamble
The Pushworth Artist Code sets out the professional, operational, and legal obligations for all Music Brands and Performers engaging with The Pushworth Group (“Pushworth”). It applies to all artists delivering live entertainment — including soloists, duos, bands, DJs, variety acts, and premium concert performers — through the Pushworth Live Booking Portal and the Access Live Client Portal.
This Code ensures:
- Compliance with the Private Employment Agents Act 2005
- Clear understanding of independent contractor status and obligations under Australian superannuation and taxation law
- Consistent high standards for performance delivery, safety, marketing, and professional conduct
- Transparent procedures for bookings, payments, cancellations, and incident management
All Artists engaged through Pushworth are independent contractors. Engagement is for a result-based entertainment service, not for hours worked, and does not constitute an employment or labour hire relationship. Artists are solely responsible for their own superannuation, taxation, and insurance obligations. Neither Pushworth nor the Buyer will make superannuation contributions on the Artist’s behalf.
By accepting any booking through Pushworth, the Artist agrees to comply with this Code in full. Breach of any provision may result in booking termination, removal from the Pushworth system, and/or financial or legal liability.
1. Onboarding and Artist Registration
1.1 Pitch Your Show
- Submit your performance pitch to Pushworth.
- Submit your performance pitch to Pushworth.
- If accepted, Pushworth will invite you to complete the onboarding process.
1.2 Onboarding Requirements
- Complete all onboarding requirements as outlined at: https://pushworth.com/artist-onboarding/
- Provide:
- Legal Entity details
- ABN and GST status (or Statement by Supplier if operating as a hobby)
- Public Liability Insurance Certificate of Currency ($20M)
- Safety documentation (SWMS, Test & Tag Certificates)
- Marketing assets as specified in section 8
1.3 Primary Contact Nomination
- Nominate a Primary Contact during onboarding. This person will:
- Confirm all bookings
- Receive contracts, gig activations, weekly confirmations, invoices, and remittances
- Access the Access.Live portal (only the Primary Contact is granted access)
- For Music Brand termination or change of legal entity, nominate a new Primary Contact and complete onboarding for the new entity.

2. Performance Delivery Standards
2.1 Arrival and Setup
- Upon arrival, report to the Duty Manager for site induction (if required).
- Be fully set up and sound-checked at least 30 minutes before the scheduled show start unless otherwise stated in the contract.
2.2 Stage and Presentation Standards
- Maintain a “general audiences” performance rating unless otherwise agreed.
- No stools/chairs on stage unless playing drums, keyboards, or pedalboard guitars.
- No lyric books on stage; discreetly placed iPad stands are acceptable.
- Dress to be distinguishable from patrons and in line with venue dress codes.
- No illicit drugs, smoking, animals, or food on stage (water permitted per SWMS).
2.3 Conduct and Communication
- Respect venue staff, neighbours, patrons, and fellow professionals.
- Zero tolerance for physical, verbal, or sexual abuse or harassment.
- Follow any venue safety instructions, promotional requests, or schedule changes provided by the Duty Manager.
3. Contracts and Documentation
- Pushworth will issue a contract for each booking.
- Verify all details (ABN, GST status, fee, performance details) before the gig.
- Any incorrect information must be reported to the booker before the gig.
- If the Artist performs under an incorrect GST status without notifying Pushworth, the contract cannot be amended afterward.
- Contracts, confirmations, invoices, remittances, and reports are sent to the Primary Contact.
4. Marketing and Promotion
4.1 Standard Marketing Obligations
- Tag @thepushworthgroup and the venue on all posts.
- Post on Facebook and Instagram no less than 72 hours before the gig (local shows: 6 days).
- Create and post a 15–40 second shout-out video for special events or tours.
- For Facebook Events, tag the venue and @thepushworthgroup as per the venue brief.
4.2 Assets – Local Shows
- High-resolution promo hero shot
- Artist bio (one line + two paragraphs)
- Spotify playlist link (cover songs – original artists)
- YouTube showreel (3–4 cover song snippets)
- All social media links

4.3 Assets – Premium Brands
- 2 x Hero images (1920×1080 landscape, 1080×1920 portrait, 72 DPI)
- Press Pack including Biography, Press Release, Logo, Style Guide.

5. Payment and Invoicing
- Pushworth invoices the Buyer once the contract is executed.
- Email your tax invoice to [email protected] matching the contract details.
- Payments are made to your registered bank account within 72 business hours of Buyer payment and receipt of a correct invoice.
- Payment terms: default 7 days net; most Buyers pay in 14–28 days.
- All changes to ABN, GST status, or bank details must be sent in writing to [email protected].
6. Cancellations
- Cancellations must be in writing (no phone/text), including contract number, performance date, venue, and reason.
- Medical cancellations require a medical certificate.
- If cancelling for another gig or due to calendar error, a cancellation fee applies.
- If Pushworth arranges a replacement, a $100 + GST fee applies unless waived.
- Emergency cancellations must call the On Call number immediately.
7. Safety and Compliance
- Maintain Public Liability Insurance ($20M)
- Tag & Test leads every 6 months
- Provide SWMS if requested
- Nominate an Artist OHS officer for site safety management
- No pyrotechnics, flammable liquids, or open flames allowed on stage
- Follow venue safety protocols when using in-house production
8. Intellectual Property
- The Artist guarantees that all images, logos, and designs used in marketing do not infringe copyright or trademarks.
- The Artist is responsible for all clearances and legal rights associated with their branding and show content.
9. Independent Contractor & Superannuation
- The Artist is engaged as an independent contractor and is not an employee or labour hire worker.
- The Artist is paid for a result-based service, not for hours worked.
- The Artist retains full creative control over performance style, repertoire, and equipment.
- The Artist is solely responsible for their own superannuation, taxation, and insurance obligations.
- The Buyer and Pushworth bear no liability for superannuation guarantee contributions.
- The Artist indemnifies Pushworth and the Buyer against any claims relating to superannuation guarantee obligations.

10. Termination
- Either party may terminate with 30 days’ written notice.
- Upon termination, all future bookings will be cancelled, listings removed, and the Artist made inactive in the Pushworth system.
- The Artist must not deal directly with Buyers introduced by Pushworth for 12 months after termination.
11. Sexual Misconduct Policy
- Zero tolerance for sexual misconduct in any form.
- Any incidents should be reported to the Police immediately.
- Victimisation of complainants is unlawful.
- Sexual misconduct includes unwanted physical contact, suggestive comments, intrusive questions, and other inappropriate behaviours.
12. Breach of Code
- Pushworth is not a free introduction service.
- Booking directly with a Buyer introduced by Pushworth within the last 12 months without Pushworth’s involvement incurs a buy-out fee of $200 + GST per show.
- Breach may result in removal from all Pushworth submissions and termination of future bookings.
By engaging in any performance booked through The Pushworth Group and onboarding to receive show contracts via the Pushworth network, the Artist confirms they have read, understood, and agreed to comply with this Pushworth Artist Code.
