SPECIFIC ARTIST REQUIREMENTS

  • This is a PARTY VENUE. Therefore your set plan must be designed to keep the audience in party mode at all times.
  • There are VOLUME RESTRICTIONS. The low volume doesn’t mean laidback.
  • Start Time is This means you need to have all your gear set up with break music playing by no later than 7.30pm.
  • Upon arrival, liaise with Duty Manager. Why? You need a weekly brief on what functions are on that night so you get a clearer understanding about how to format the night according to each individual function needs.
  • Each artist needs to be flexible and be professional and work WITH whatever the venue needs.
  • Start the night with up-tempo song selections. The low volume doesn’t mean laidback. Always keep the entertainment of the audience foremost in your set plan.
  • Produce specific Party Break music to ensure that the atmosphere continues even when you are off stage. Your job as the Artist is to keep the audience partying and well entertained.

PRODUCTION

PLEASE ARRIVE AT LEAST ONE HOUR PRIOR TO PERFORMANCE TIME

UPON ARRIVIAL PLEASE REPORT TO THE DUTY MANAGER OR BAR STAFF AND ASK THEM TO BRING OUT THE PA SYSTEM FOR YOU.

ONCE THE PA IS IN PLACE, POWER + CONNECTION TO THE FOH CAN BE FOUND IN THE SQUARE TRAPDOOR ON THE STAGE – PLEASE HAVE EXTENSION LEADS + POWERBOARDS + 2 SPARE XLR LEADS

SET UP YOUR DESK AND FOLDBACK AND BACKLINE AS PER NORMAL(THIS IS NOT SUPPLIED BY THE VENUE)

TURN ON POWER AMPS – ENSURE ALL LEVELS ARE SET TO A MINIMUM WHILE YOU CONNECT SPEAKERS UP

Volume Restrictions

PUBLICITY STANDARD

  • We encourage all Artists to actively engage in Social Media to build and connect with your fan base.
  • Artist to provide High resolution unedited Publicity Photograph 10 weeks in advance of each show
  • Artist Digital Poster must be shared on Artist Social Media and Artist Website tagging the Venue 2 weeks prior to each gig.
  • Artist to post a Facebook Event Listing for every show
  • Artist is Available for Interview with Local Radio or Print Media – offer CD or Merchandise Item for Media Giveaway to generate interest

PUBLIC SAFETY

  • Artist must meet with the Duty Manager 60 MINUTES PRIOR TO START TIME for each Performance for Induction and Brief of Event Requirements.
  • Artists to provide PUBLIC LIABILITY INSURANCE CERTIFICATE OF CURRENCY $20 MILLION
  • Artists to provide SAFE WORK METHOD STATEMENT – detailing your safety processes in your installation, performance and dismantle activities for each gig.
  • Artists will maintain TAGGED AND TESTED LEADS every six months.
  • Artists to take reasonable care to ensure health and safety protocols for band members and audience members and venue staff are adhered to and will provide all necessary hardware/materials to ensure safe and efficient set-up of their staging and will ensure that no performers incite unsafe behaviour from the audience e.g. climbing onto the stage, throwing bottles at the stage or unsafe dancing etc.
  • Absolutely no pyrotechnics or flammable liquids, open flames or burning allowed on stage.
  • The Venue Duty Manager reserves the right to intervene at their discretion to halt unsafe practices during your performance.

CANCELLATION

  • The Breakfast Creek Hotel reserves the right to cancel a performance if:
    • Performance conditions are deemed unsafe or untenable due to inclement weather
    • A performer does not show up on time for his or her performance
    • In the event of a Force Majeure/Act of God (e.g. fire, flood, earthquake, destruction of property, labour disputes, etc.)
  • Once a performance date is contracted between the Artist and the Venue, the performance agreement must be honoured by the Artist unless illness, Acts of God or unforeseen circumstances beyond anyone’s control occur
  • In the case of illness, a doctor’s certificate must be emailed to Pushworth within 24 hours.
  • In the case of a car accident, a police report must be emailed to Pushworth within 24 hours.
  • In the case of any other reason, a detailed email must be provided to Pushworth within 24 hours.

HOSPITALITY RIDER

  • No Alcohol will be provided to Artists.
  • Unless otherwise arranged, all artists will be entitled to glasses of water.
  • Feature and Touring Shows Hospitality Riders will be negotiated at the time of booking confirmation.

BREAKFAST CREEK HOTEL VENUE CODE

  • One representative for each band will be the Primary Contact and will be legally responsible for the Authorization, Management, Induction, Debrief, Compliance and Feedback for each individual band member and crew that accompanies the band onstage or backstage at every performance facilitated by Pushworth.
  • The Artist agrees to be responsible for their own authority, employment and services contracts and payments related to their performers and crew.
  • The Artist agrees that they are Sub Contractors responsible for their own Taxation, Superannuation and Public Liability Insurance.
  • The Artist agrees that every performer and crew is at least 18 years of age, has read and understand this code of conduct, and is competent to execute this agreement on behalf of the band.
  • The Artist agrees to obtain all necessary permits and consents from any relevant authority to the conducting of the engagement contracted hereunder and all matters incidental hereto and to comply with all conditions imposed in connection with the granting of any such permits and consents.
  • The Artist agrees that the line-up marketed to Pushworth and then to BREAKFAST CREEK HOTEL is the same line-up that performs at the gig.
  • Changes in line-up MUST be notified to Pushworth prior to the performance. Pushworth will advise the venue. BREAKFAST CREEK HOTEL has the right to cancel the performance if the line-up change isn’t to their satisfaction.
  • The Artist agrees to meet with the Duty Manager 60 MINUTES PRIOR TO START TIME for each Individual Event.
  • The Artist agrees to produce suitable break music to ensure that the atmosphere continues even BEFORE DURING AND AFTER the stage performance.
  • Other than drummers or keyboard players it is not acceptable for artists to be seated on stools or chairs.
  • No music stands on stage to hold books to read lyrics. A discreetly placed stand holding an iPAD is acceptable.
  • The Artist agrees to observe a Dress code in accordance with the rules of the venue and dress like a paid entertainer and not like a patron.
  • The Artist agrees to indemnify Pushworth for any loss or expense incurred by Pushworth arising out of the cancellation or non-performance of a Performance. In such case, the Artist shall be liable to pay Pushworth the booking fee as specific in the schedule.
  • BREAKFAST CREEK HOTEL reserves the right to remove any band or cancel any/all performances that does not abide by this Code.

BREAKFAST CREEK HOTEL OBLIGATIONS

  • Breakfast Creek Hotel agrees to obtain all necessary permits and consents from any relevant authority to the conducting of the engagement contracted and all matters incidental and to comply with all conditions imposed in connection with the granting of any such permits and consents.
  • Where normal power supplies are not available, Breakfast Creek Hotel shall provide a safe, properly supervised generated system operated by qualified persons.
  • Breakfast Creek Hotel shall also indemnify the Artist for any loss, damage or injury arising through any malfunction thereof.

GENERAL GIG INFORMATION

Animals

Animals are not permitted onstage or backstage.

Artistic Content and Rating

  • BREAKFAST CREEK HOTEL exerts no control over the artistic content of an Artist’s performances other than a repertoire style requirement designed specifically to satisfy the audience OR to build an audience culture.
  • All performers agree to provide a full song list to business@pushworth.com every six months to be displayed on the Pushworth website Artist page.
  • All performers must maintain a “general audiences” rating for their performance.

Behaviour Expectations

  • Artists agree to treat staff, volunteers, and patrons with respect, and vice-versa.
  • There is zero tolerance for physical and/or sexual abuse or harassment. Infractions will result in immediate expulsion from the Venue.
  • Verbal abuse will not be tolerated. Any artist found in violation will receive expulsion by BREAKFAST CREEK HOTEL for the second offence and will not be paid the performance fee.
  • Consumption of illegal drugs onstage and backstage is strictly prohibited.

Competition Clause

  • To maintain a professional booking protocol and to give the venue a Point of Difference in the market, no Artist who has performed in Ipswich in the previous 8 weeks at another Ipswich venue will be booked at Breakfast Creek Hotel unless otherwise directed or agreed by management.

Complaint Policy

  • It is the duty of BREAKFAST CREEK HOTEL (or assigned employees and agents) to be present on site to view all performances or Entertainment service provision.
  • Should BREAKFAST CREEK HOTEL wish to terminate the performance due to a perceived default in standard of performance or service provision, they must do so within the first 20 minutes of performance or service provision.
  • A Client Complaint Report form must be completed and returned to Pushworth within 48 hours. This will be evaluated by the Artist who has the right to defend their performance with a written response.
  • Both parties are to provide 2 unrelated witnesses to provide evidence to support their claim.

Dealing Directly with Artist

  • BREAKFAST CREEK HOTEL has engaged the services of Pushworth to propose and provide a suitable Artist for the Live Entertainment Program and Pushworth has in response thereto introduced the Artist to provide services as specified in the schedule.
  • BREAKFAST CREEK HOTEL will not engage the services of the Artist directly or via another source without using the services of Pushworth and paying the Booking Fee. Pushworth shall be entitled to a Booking Fee for the whole of the time that the Artist is at BREAKFAST CREEK HOTEL to a maximum period of 12 Months.
  • Upon the termination of this agreement and in the event that the Artist continues to provide services for BREAKFAST CREEK HOTEL , then Pushworth shall be entitled to retain an amount of money equivalent to 12 Months Booking Fee from monies held on behalf of the Artist as security.
  • In the event of a Venue Manager or Representative moving from one venue to another, that person is under obligation to the Pushworth Booking Protocol and cannot engage the services of any Artist introduced to him without contacting and booking the Artist through Pushworth.
  • Change of act name does not alter this obligation.

Food

  • No food or beverages (with the exception of water) are permitted onstage.
  • Drinks may be consumed back or side of stage and disposal of cans and bottles into the provided bin.
  • Food may be consumed back or side of stage with plates returned to the kitchen and area maintained according to OHS guidelines.
  • If you have specific dietary needs or suffer from allergies, it is your responsibility to provide your own meal/snacks.

Gig Feedback – After Sales Service

  • Our Bookers will communicate with a duly appointed Venue Representative every week for Gig Feedback.
  • Our Bookers will address any concerns and make all changes as required.
  • All changes will be confirmed in writing once completed.

Lost and Stolen Property

  • BREAKFAST CREEK HOTEL is not responsible for any items belonging to artists that have been lost or stolen.
  • BREAKFAST CREEK HOTEL does not assume any liability for any damage, theft, or other loss to Artist equipment or personal belongings that occurs as a result of performance onstage or storage backstage.

Media Protocol

  • THE ARTIST gives consent that a BREAKFAST CREEK HOTEL authorized photographer has the right to take photographs, videotape, or digital recordings of the band at every performance booked by Pushworth and to use these in any and all media, now or hereafter known, and exclusively for the purpose of marketing.
  • THE ARTIST further consents that band name and identity may be revealed therein or by descriptive text or commentary.
  • THE ARTIST does hereby release to PUSHWORTH its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately.
  • THE ARTIST waives any rights, claims, or interest to control the use of the band identity or likeness in whatever media used at Performances facilitated by Pushworth where a Pushworth authorized photographer or Media is filming the performance.

Smoking

In accordance with City bylaws, smoking is not permitted onstage or backstage.

Times

  • An Artist must synchronize their watch with the Duty Manager when they first arrive to ensure they maintain their official time.
  • All staff, artists, and technicians will set their time-telling devices to Official Gig Time, as well as clocks at the FOH tables at each stage set to OGT. Performances begin strictly on time. In any dispute over performance start/end time, we shall defer to OGT.
  • Performance Times will be noted on each Show Worksheet
  • Artists are to strictly adhere to performance, Set Up + Sound Check times
  • The Artist MUST have Break Music playing 30 MINUTES PRIOR TO START TIME and 30 MINUTES AFTER THE SHOW HAS COMPLETED.
  • From time to time there are Sporting Events prior and post Shows which make require the delay of early completion of Break Music. This will be advised at the show by the Duty Manager.
  • Artist will notify the Duty Manager to put In House Music on directly upon finishing the final Break Music post completion.
  • Breaks; a performers break must be no longer the half the length of the previous set. All acts must provide music during breaks
  • LOAD OUT should be immediately after performance.
  • Each artist agrees to be flexible and be professional and work WITH whatever the venue needs.

Venue Code

  • The Management of Breakfast Creek Hotel reserves the right to change this Code as required.
  • All changes will be notified in writing to all performing Artists.

Accounts Receivable Process

  • Invoices are issued and emailed to the ALH Accounts Department every Monday AFTER the entertainment weekend. (Tuesday in the event of a public holiday)
  • ALH is requested to pay invoices within seven days of issue.
  • A Collections Report is then emailed to ALH every Thursday with weekly follow up communication until payment is made in full.

Payments to Artists via Pushworth

  • Payments for Entertainment will be made to Pushworth by the venue for the Artist who will email the Correct Tax Invoice to accounts@pushworth.com
  • Pushworth pays the Artist within 72 business hours upon receipt, clearance and processing of the payment made in full by the venue.
